The claims process

At this firm you will always be treated as an important individual.  This is an outline of how your compensation claim might develop with this firm as your personal injury claim solicitors.

The first meeting

After listening to the story of how your illness or personal injury was caused and advising you by phone, a meeting with you will be arranged without commitment.  The purpose of that meeting will be to:

  • Take fuller details of the claim
  • Explain the help offered take your case forward and give you an idea of the chances of success and how much compensation you might receive
  • Confirm you will recieve 100% of your compensation

You can then decide if you want to go further.

Putting the claim forward

A letter will be sent to the person to blame requesting they admit responsibility and make payment. Witnesses will be interviewed quickly before memories fade.

Medical matters

Arrangements will be made for you to see a specialist doctor at a venue convenient to you. They will provide a confidential report. If you are happy with what it says it can be used to value your case.

Sometimes a second report is needed because it isn’t known how bad your injury or illness may become. If other types of expert are needed, such as engineers or accountants to prove your case they can be involved. You won’t be asked to pay for them.

Other party not co-operating

If the other party is not giving the information or documents they should to assist with your case the Court can be asked to make them do so without starting full court proceedings.

Valuing your claim

With the medical report and details of your losses it’s possible to discuss you the right amount of compensation in your case.

Offering to settle

It is often better to take the initiative and tell the Defendants how much you require, to settle your case.

Early part payment

If it’s too early to know how serious your injury or its effects will be, you can demand an early part payment. In some cases the Court can order this. For example to

  • pay for private medical treatment; and
  • otherwise ease financial losses or strain

Settling your compensation claim

If a settlement can be negotiated for you without having to start court proceedings you will receive your compensation at that stage.

Starting court proceedings

If necessary to get justice court proceedings can be started without delay, but only if you wish to. You will receive the advice you need to:

  • protect you against financial risk.
  • decide if started legal proceedings is what you wish to do.

An improvement in any offer to settle may be received at this stage and you may be able to settle your case without going to court.

At court

Less than 2% of cases go to Court for a judge to decide. If that happens you will be represented and looked after at Court by an experienced lawyer.

If you win, you will normally receive all the compensation the Judge awarded you.
